Terms and Conditions

Last updated: 8 October 2026
This English version is provided for convenience only. The contract language is German; in the event of any discrepancy, the German version shall prevail.
§ 1 Scope
(1) These General Terms and Conditions (GTC) apply to all contracts for the purchase of books concluded via the online shop at https://systola.pub/en between Roman Kuznetsov, trading under the business name "Systola Publishing" (hereinafter "we"), and the customer.

(2) A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession (Section 13 of the German Civil Code, BGB). A trader is any natural or legal person or partnership with legal capacity who, when entering into a legal transaction, acts in the exercise of their trade, business or profession (Section 14 BGB).

(3) Deviating or supplementary terms of the customer do not form part of the contract unless we expressly agree to their validity in text form.

(4) Purchases from third-party providers whose offers we link to (e.g. Amazon) are governed exclusively by the terms of the respective provider.
§ 2 Contracting Party, Contract Language
(1) The contracting party is Systola Publishing, owner Roman Kuznetsov, Am Güterbahnhof 8a, 21035 Hamburg, Germany.

(2) The contract language is German.
§ 3 Conclusion of the Contract
(1) The presentation of books in the online shop does not constitute a legally binding offer but an invitation to place an order.

(2) The customer places the desired items in the shopping cart, enters their billing and delivery details and selects a payment method. Before completing the order, all details are displayed in an overview, where the customer can correct input errors using the editing functions or the browser's back function.

(3) By clicking the "Place final order and pay" button, the customer submits a binding offer to purchase the items in the shopping cart. We confirm receipt of the order by email without delay; this confirmation of receipt does not yet constitute acceptance of the offer.

(4) We may accept the offer within two working days by sending the customer an order confirmation by email or by dispatching the goods, whichever occurs first. If we do not accept the offer, we will refund any payments already made without delay.

(5) We store the contract text and send the customer the order details and these GTC by email. The GTC can also be accessed at any time at https://systola.pub/en/agb. The specific order details can no longer be accessed via the shop once the order has been completed.
§ 4 Prices and Shipping Costs
(1) All prices are final prices in euros. As a small business within the meaning of Section 19 of the German VAT Act (UStG), we do not charge VAT and therefore do not show it.

(2) Our books are subject to fixed book prices. The prices stated are the retail prices fixed in accordance with the German Book Price Fixing Act (Buchpreisbindungsgesetz).

(3) In addition to the purchase price, shipping costs apply depending on the country of delivery. Shipping costs are listed on our main page and are shown separately during the ordering process before the order is placed.
§ 5 Delivery
(1) We deliver to addresses in most European countries.

(2) Delivery takes 4–6 working days within Germany and 6–15 working days to other countries. The period begins on the day after the contract is concluded. If a different delivery time is stated for an item, that delivery time applies.

Books marked in the shop with a release date ("Out …") may be ordered before release; in this case the delivery period begins on the release date.

(3) Should an item not be available contrary to the information in the shop, we will not accept the customer's offer. We will inform the customer without delay and refund any payments already made without delay.

(4) For orders of several items, we are entitled to make partial deliveries where this is reasonable for the customer. The customer will not incur any additional shipping costs as a result.
§ 6 Payment
(1) Payments are processed by the payment service provider Stripe Payments Europe, Ltd., 1 Grand Canal Street Lower, Grand Canal Dock, Dublin, D02 H210, Ireland ("Stripe"). We offer the following payment methods: credit and debit card, SEPA direct debit, Apple Pay, Google Pay and Klarna. The payment methods available in each case are shown during the ordering process.

(2) The purchase price is due immediately upon conclusion of the contract.

(3) When paying by credit or debit card, Apple Pay or Google Pay, the amount is charged when the order is placed. If no contract is concluded, we will refund the amount without delay.

(4) When paying by SEPA direct debit, the customer grants a SEPA direct debit mandate. The period for advance notice (pre-notification) is shortened to one day before the due date. The customer ensures that the account has sufficient funds. The customer bears the actual costs of any chargeback for which the customer is responsible.

(5) When paying via Klarna, Klarna's terms, which are referred to during the ordering process, apply in addition.
§ 7 Retention of Title
The goods remain our property until paid for in full.
§ 8 Right of Withdrawal
(1) Consumers have a statutory right of withdrawal. Details are set out in the withdrawal policy below.

(2) Withdrawal can also be declared using the "Withdraw from contract" button, which is available in the footer of every page of the shop during the withdrawal period.

(3) Traders have no right of withdrawal.
§ 9 Liability for Defects
(1) The statutory rights in respect of defects apply, unless otherwise provided for traders in § 11.

(2) If items are delivered with obvious transport damage, we ask the customer to report this to the carrier and to inform us as soon as possible. The customer's statutory rights remain unaffected.
§ 10 Liability
(1) We are liable without limitation for intent and gross negligence, for injury to life, body or health, under the German Product Liability Act (Produkthaftungsgesetz) and to the extent of any guarantee we have given.

(2) In the event of a slightly negligent breach of an obligation whose fulfilment is essential for the proper performance of the contract and on whose observance the customer may regularly rely (cardinal obligation), our liability is limited to the foreseeable damage typical for this type of contract.

(3) Otherwise, liability for slightly negligent breaches of duty is excluded.

(4) These liability provisions also apply in favour of our vicarious agents.
§ 11 Special Provisions for Traders
(1) Traders, in particular bookshops, may order via the online shop. Trade terms, deviating payment terms and delivery methods are agreed individually upon request by email. For contracts with traders, these GTC apply with the following deviations.

(2) We grant trade terms within the scope of Section 6 of the German Book Price Fixing Act.

(3) The risk of accidental loss and accidental deterioration of the goods passes to the customer upon handover of the goods to the carrier.

(4) If the customer is a merchant (Kaufmann), the obligation to inspect and give notice of defects under Section 377 of the German Commercial Code (HGB) applies.

(5) Claims for defects become time-barred one year after delivery. This does not apply to claims under § 10 (1) or to recourse claims under Sections 445a, 445b and 478 BGB.

(6) A right to return unsold copies exists only if separately agreed.

(7) The resale of goods subject to retention of title in the ordinary course of business is permitted. The customer hereby assigns to us all claims arising from the resale in the amount of the invoice total; we accept this assignment. The customer remains authorised to collect these claims as long as they meet their payment obligations.

(8) The application of the UN Convention on Contracts for the International Sale of Goods (CISG) is excluded.
§ 12 Final Provisions
(1) The law of the Federal Republic of Germany applies. In relation to consumers, this choice of law applies only insofar as it does not deprive them of the protection of mandatory provisions of the law of the state in which the consumer has their habitual residence.

(2) If the customer is a merchant, a legal entity under public law or a special fund under public law, the exclusive place of jurisdiction for all disputes arising from this contract is Hamburg.

(3) We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.

(4) Should individual provisions of these GTC be invalid, the remainder of the contract remains valid.

We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.
